What are a producer’s rights against infringing parties?

The producer whose rights to the database have been infringed may request that the infringing party: ceases the infringement, removes the effects of the infringement and repairs the damage caused, either in accordance with general principles or by payment of a sum of money in the amount corresponding to twice or – in case of culpable infringement – three times the appropriate remuneration which, at the time of pursuing it, would be due for the authorized person’s consent to use the database. Should an infringement of a database occur, the producer may also request the infringing party to return any benefits obtained by it.

Irrespective of the claims referred to above, the producer may require that a one-off or repeated statement be published in the press, containing appropriate content and having appropriate form, or that some or all of the court rulings issued in the case under consideration be publicized in the manner and to the extent specified by the court.
